We’ll all pay a share

We tried — and failed.

The Mississauga News has lost its bid to have Peter McCallion’s financial information — contained in a sworn affidavit — disclosed to the public, even though the commissioner of the judicial inquiry has recommended taxpayers foot his legal bill.

Commissioner Douglas Cunningham, who’s adjudicating the Mississauga judicial inquiry that is investigating issues around the City of Mississauga’s acquisition of approximately 8.5 acres of land and the December 2000 Enersource Shareholders Agreement to which the City was a party, said he was keeping McCallion’s affidavit sealed because it was “precisely the kind of intimate financial information” that he had the discretion to protect.

Considering McCallion’s lawyer has already publicly documented her client earned less than $60,000 last year as a real estate agent, has a $5,000 monthly mortgage payment and owes the Canada Revenue Agency at least $12,500, there appears to be little to hide.

Earlier, Cunningham had suggested the City of Mississauga should pay Peter McCallion’s legal bills because Council had pushed for the inquiry, effectively putting McCallion at the centre of the process.

But, regardless of who initiated the inquiry, the costs will be borne by residents — a fact Cunningham didn’t address in his ruling — who have an undeniable right to know how their hard-earned tax dollars are being spent by the City or any other level of government. In particular, taxpayers should be entitled to know how a private citizen is spending their money.

Although much has been made about the need for transparency in matters at City Hall, apparently the same boundaries do not apply at the inquiry level.
Mississauga residents are being kept in the dark yet again.

Tony, regarding "under-the-table-deals", the Inquiry hasn't even gotten to that aspect of the investigation. Until that happens these are *alleged* under-the-table-deals. You wrote, " An experienced lawyer (fully paid by the taxpayers)" --not just that "experienced" but upper-tier top who worked on the Walkerton Inquiry, the Air India Inquiry and the Arar Inquiry". It's vital he get the Best and Free. While there are still those who can call how Peter McCallion's treatment Kangaroo-ey, only the same types (who refuse all evidence) will agree.

The tax payers will the only looser........

It's very true that P.McCallion can't afford that much money from his declared (to CRA) income. Whatever he obtained through under-the-table-deals by leveraging his mother’s office and that undisclosed amount of settlement from OMERS on the failed land deal, are all black money. An experienced lawyer (fully paid by the taxpayers) and the leniency of Canadian laws applied to white collar crimes will make sure Mr.McCallion has nothing to worry about.

Therese, try and put yourself in Peter McCallion's place. You're just minding your own business and *WHAP* this rare event called a Judicial Inquiry happens and you're smack in the middle of it. How'd you like that? This isn't a criminal proceeding. He's not charged with anything. I don't think that anyone should have to foot a lawyer's bill to satisfy a government-related curiosity (even a mega-curiosity like this one). Peter McCallion's lawyer served as "commission counsel for the Walkerton Inquiry, the Air India Inquiry and the Arar Inquiry." Who wants to pay for THAT out of pocket? Peter McCallion deserves his privacy. We ALL do. If we can't trust the Commissioner to make this call, how can we trust him to conduct the entire Inquiry. You have to keep your faith somewhere. It's Amazing that the Mississauga News Failed in this matter

And it concerns me about the bias of the Commissioner. Yes, we're footing the bill, yet we aren't allowed to see the questions Mr. Cunnigham asked P. McCallion. That's amazing. P. McCallion can't afford lawyers, yet he can afford $5,000/month to retain the house that was once his own. If he can't afford his lawyers, why doesn't he move in with his MOM?

You wrote, "We tried — and failed." Yes you did. And we (almost) all thank you. Take it from someone who's failed and failed and failed, it's the trying that's important. MissyNews wrote, that citizens "have an undeniable right to know how their hard-earned tax dollars are being spent by the City or any other level of government." Sorry. Have to disagree. That "undeniable right" is veneer --the rancid stuff of paper policies that make Ontarians think that government is serving at citizens' pleasure. That Follow the Money Trail right is "undeniable" until you exercise it.
