Barber appeared before the Mississauga City Council, purportedly on the issues of geese and the 'old tree' by-law. During his remarks, Mr. Barber stated that Councillor N. lannicca, a member of the Regional Municipality of Peel Police Services Board, did not support the tree by-law for reasons to do with the Canadian Charter of Rights and Freedoms. Mr. Barber went on to say and I quote from the video transcript: "Councillor Nando lannicca abused his position on the Police Services Board by sending police to his door for no reason, other than the fact that he represented a group of people who disagreed with the City of Mississauga .... it was a deliberate set-up to not allow his filing of a public complaint against Councillor lannicca's actions." As Chair of the Board, I do not normally respond to unsubstantiated and unfounded allegations. However, given the nature of Mr. Barber's comments, and the forum in which they were made, I believe it is important to respond. I wish to inform City Council. that there is absolutely no truth to the spurious allegations made by Mr. Barber. Although I am prevented by statute from going into details, I can assure Council that Mr. Barbers charge of abuse of authority is totally contradicted by fact. Councillor lannicca has been and continues to be a member in good standing of the Board. His conduct has been above reproach. E. Dear Sir: I am filing a formal complaint against E. Kolb the Chair of the Police Services Board (PSB). You have informed me in the past there is not time limit on complaints against PSB members, so that should not be an issue. Referring to E. Kolb's July 7/2000 letter, he sent to City of Mississauga Clerk, Arthur Grannum (enclosed), his comments are at issue. E. Kolb refers to my 1998 attempt at filing a complaint against City of Mississauga Councillor N. Iannicca. His comments, that were published in the City's Council agenda (Aug. 16/2000), thereby, putting them in the public record, are untrue. E. Kolb is commenting on the statements I made in City of Mississauga Council June 14/2000. That the PSB didn't allow me file a complaint against Councillor N. Iannicca, who was sitting on the PSB. E. Kolb referrers to my statement in the following ways, "to unsubstantiated and unfounded allegations.", "I wish to inform City Council that there is absolutely no truth to the spurious allegations made by Mr. Barber." and "I can assure Council that Mr. Barbers charge of abuse of authority is totally contradicted by fact." E. Kolb has public stated falsehoods. The record clearly shows that I never presented the details of my complaint to the PSB, as the PSB didn't forward the requested material regarding procedure for filing a complaint with the PSB and then the PSB made a ruling without the facts of the complaint. The details that E. Kolb didn't wish to mention as they would make him and the PSB look like fools are as follows; 1). Letter dated - June 23, 1997 (the year was really 1998). I state my intention to file a formal complaint against City of Mississauga Councillor N. Iannicca, who sits on the PSB. I ask how for the procedures in filing a complaint from the PSB. 2). Letter dated June 29, 1998. The PSB replies that I will be advised regarding procedures "as soon as possible". 3). Letter dated - July 11, 1998. After being attacked, I repeat my request for how to file a complaint with the PSB. 4). Letter dated - July 22, 1998. I state sections of PSB code complaint is about and again repeat request for proper process for a PSB complaint. I clearly state that more details will be provided after I receive the required information from the PSB. It is also clear that there was some concerns on my part about filing the complaint in a certain time frame and would account for my efforts state my intentions for being on the record that a complaint was being filed. 5). Letter dated - July 29, 1998. The PSB states it has considered my complaint and dismissed it. 6). Letter dated - July 31, 1998. Frederick Biro, Executive Director, PSB, appears confused as he tows the PSB line about dealing with a complaint that was never fully filed and then begins to supply information about PSB complaint process, after the complaint has been dealt with. This is a clear cut case of totally unprofessional conduct by the PSB. It was clearly noted in the exchange of letters that the PSB was not supplying necessary information for the complete filing of a complaint against one of its members. That details were yet to be supplied, in fact no details of his conduct were supplied. Any haft way intelligent member of the public can easily see these facts and given the fact the PSB dealt with this in camera to ensure no records would exist of its improper actions, speaks volumes of how the PSB does its business. Therefore, it is an abuse of authority on E. Kolb's part to make statements that are totally contradicted by facts. E. Kolb actions in violation of the Regional Municipality Peel Police Services Board, Code of Conduct in the following ways; a). Sec. 4, this item was discussed in camera at a PSB meeting, then E. Kolb publicly presents the private and confidential outcome to the public. He tries to cover up his July 7/2000 letter by not sending a copy to me. b). Sec. 5, I have been informed E. Kolb's wrote his July 7/2000 without discussing it with the PSB first. c). Sec. 7, E. Kolb has shown a basis for a fellow PSB member by making falsely statements regarding the a complaint made against him. d). Sec. 8, the public will clearly see that E. Kolb has not discharged his duties in a manner that will not inspire public confidence and will degrade the integrity of the PSB by not factually reporting the events in question. e). Sec. 9, he has no regard to my dignity and it is clear I was taken advantage of because I was ignorant of proper procedure. In his July 7/2000 letter I am wrongly portrayed to in a negative fashion. f). Sec. 10, E. Kolb has used his office to wrongfully aid the political career, in an election year, of Councillor N. Iannicca, to whom he associates with. Politicians from the City of Mississauga are and have been for some time engaged in slandering those who fight hard for their communities, while disagreeing with the City. E. Kolb is helping in those immoral efforts by using the good name of the PSB. g). Sec. 13, E. Kolb by writing his July 7/2000, has engaged in conduct that discredits and compromises the integrity of the PSB. Please note this letter and other details of this matter are being posted on my internet page, so the whole world can see what the PSB is really doing. Dear Police Services Board: I would like to file a formal compliant against a member of the Police Services Board, Councillor N. Iannicca. For his role in using police against me and to benefit Councillor C. Corbasson. Do I file it with the Police Services Board or the Ontario Civilian Commission on Police Services? And what is the procedures to follow? Please note it was not until May 4/98 that I was supplied with the Code of conduct in regards to how members of the Police Service Board are to act; therefore I was not in a position to file a compliant before hand. Dear Police Services Board: I have just been attacked by a political person and this is not a joke any more. These people think they can attack me at will!! I need to know, now, how to file a complaint against members of the Police Service Board, who is investigating the Chief of police in regards to my last complaint against him and who do I file a complaint against the Chief of police with. Dear Sir: I am filing a formal complaint against N. Iannicca City of Mississauga, Councillor. Referring to the Peel Police Services Board (PSB), Code of Conduct, faxed to me, May 4/98, items 8, 9, 10, and 13, are ones that I am (at this time), complaining he has violated and I would ask that item 14 be enforced. More details will be provided after the Police Services Board informs me of the process it wishes to use in dealing with this complaint. If the PSB. wishes to use the Code of Conduct, used at the time of the event, May 28/97, then please forward a copy of it to me. Please note that N. Iannicca's involvement in this matter was not borough to my attention till Oct. 8/97 and it was not till May 4/98 that I became aware that action could be taken in regards to his conduct, therefore I am not too late in filing this complaint. cc. Iannicca, a member of the Board. The Board adopted the following motion: "Pursuant to the Code of Conduct for Board members, and following a review of the material presented in correspondence dated June 23, 1998, from Mr. A Barber, the Board finds the complaint to be without substance, and deems its review of this matter to be concluded " If you are not satisfied with the Board's decision, I would suggest you contact the Ontario Civilian Commission on Police Services, the provincial body responsible for the oversight of police services boards. Iannicca, a member of the Regional Municipality of Peel Police Services Board. I would ask if you could clarify if this is a new complaint, or concerns the complaint you referenced in your letter of June 23, 1998. The initial complaint was dealt with by the Board at its In Camera meeting of July 17, 1998, and a copy of its decision was forwarded to you in a letter dated July 29, 1998. If this is a new complaint, I would ask if you could provide sufficient details in written form for the Board to make a decision as to how to proceed.
