Dear Mr. Barber:
This is in response to your December 5, 2008 submission to my Office regarding certain actions of the City of Mississauga council and council's current efforts to establish a complaints process. You have requested that I write to the city regarding the prospect of my Office investigating certain complaints directed towards the city.
As you are aware, the Ombudsman Act does not provide the Ombudsman's Office with authority to investigate complaints against municipalities in Ontario, other than complaints about closed meetings under the Municipal Act, in certain circumstances. In light of this, it would not be appropriate for my Office to attempt to directly intervene in the business of Mississauga city council. I would, however, be pleased to consider any proposals put forward, should the City of Mississauga or the government of Ontario wish to explore options to provide my Office with the authority to investigate complaints in the city of Mississauga.
