Mischief charges relate to wilfully destroying or damaging property and/or data. While the boy seemed to be an unresponsive bystander, I don't think that he should have been charged with mischief. The only charge would be against posting a video that identifies under-aged people who may be involved in a criminal act. If he had blurred out the faces, then it would be no different than a TV station posting a similar video. However, what the boy allegedly did does not constitute a mischief charge by definition. The kid filmed a fight which is probably good for evidence just in case more became of this or something bad happened afterwards and he gets charged? Are you kidding me. So filming is against the law? Since when. This is a joke really terrible, I feel sorry for the parents and the kid, The Police should be ashamed of them self putting a 13 year old in handcuffs for filming a fight. Imagine the harm they have done to the kid and the parents. The Police go way overboard sometimes and are way out of line. No wonder crime is everywhere in Peel, I challenge the Police to do something about the Drugs in Peel or the Escort services in Peel that are openly on the internet on a daily basis. We have very serious problems in Peel and it does not include a 13 year old video tapping a fight. GIVE ME A BREAK what type of example of Policing is this. I cant believe Im reading this. We see serious cases of cyber bullying constantly. It's important to take action early and teach children that the internet/Facebook is not the "wild west". This guy will hopefully see how serious being an immature idiot bystander in bullying is. Also the other students at the school will see the same. This boy will never learn though, when mom sits back and blames the school and the police for her son's actions. She should take away all his internet access and gadgets that support wifi for a while until he grows up. Eveyrone taken into custody is cuffed as a matter of policy for officer safety as well as the safety of the accused. My problem in this case is the involvement of police at all. to me, it is an overreaction by the school. Disagree 4 Ernst Blofeld Dec 27, 2012 8:14 AM True... ...that the handcuffs are a bit extreme. However. It is protocol. A policy put in place to ensure the safety of the person wearing them, and the police who put them on. It is easier to place handcuffs on at the outset of the arrest, instead of waiting until the person begins fighting or being uncooperative. Look at it this way: They don't place the kid in handcuffs, and he decides to resist - kick, punch, whatever. The police then have to subdue him, putting both the officer and the student at risk of injury. Not only does that look far worse than just walking him out in cuffs - but the public outcry of unneccessary force would be deafening. Stop being a bunch of bleeding hearts. If the kid was such a sweet little boy, his mom wouldn't be in a dispute with the school, and he never would have been arrested. There is likely more to this story than what was revealed to the media. Agree 5 30 Dec 27, 2012 7:07 AM Mom Needs a Reality Check While I agree that handcuffs (and perhaps even the charges) are a bit extreme, the mother is way off base here. Blaming everyone else for your child's behaviour speaks volumes. As does the fact that she has a long-running dispute with the school. Also, why would school staff warn her son before calling him to the office, and what difference would that make? Sounds to me like the mother needs to take a good hard look at her responsibility for her son's actions. Agree 4 Mantis Dec 26, 2012 9:34 PM Over-Reaction Schools today seem too quck to over-react to every little thing. I can clearly remember that we used to have fist-fights in the school yard and the teachers would break up the combatants, and send them to the principal's office for a stern lecture before sending them back to class. Now, the same sort of thing involves, police, criminal charges social workers, suspensions and expulsions. At some point, schools have substtiuted zero-tolerance for common sense. I feel an urge, to calm down the parties at war because it will be your kids that will suffer at the end. It is your kids that will be dragged into court room and exposed to screaming parents, indifferent police officers, pathetic disputes over who did what while lawyers will charge their usual hourly fee. One thing is certain: your kids will step out of that courtroom the same they went in. It is You, my dear parents along with the impotent school stuff that will mess up their childhood. Moms and Dads, you are way better off to Bahamas . This is no longer kids fight, this escalated to a dirty parents fight and your kids will be collateral. From where I am standing, the whole incident qualifies as disgusting behavior of upset parents and lame school staff .
