Citizen advocate's lawsuit in question

Time is running out for self-styled City Hall watchdog Donald Barber to sue Mississauga and Peel Regional Police over his arrest in 2006 on assault charges that were subsequently withdrawn.

Barber, 53, launched the lawsuit in small claims court, claiming $10,000 plus court costs from each of the parties, last March without the aid of a lawyer, which he said he can’t afford because he is unemployed and poor.

He was subsequently advised by the court that he must refile his statement of claim to clarify his allegations.  He has until April 6 to do so or the lawsuit will expire.

Among his allegations, which have not been proven in court, are malicious prosecution, negligent investigation, assault and arbitrary detention.  Both the City and Peel Police Services Board have filed court statements denying all the accusations.

The City further claims the lawsuit wasn’t filed within two years of the original incident, which is beyond the legal limit for such an action.

Barber has been seeking a lawyer willing to take the case for free, on the basis that it is in the public interest to defend the right to free speech, but has been unsuccessful.  Unless someone steps forward he will have to do it himself, he said.

“The odds are very much against me, yet efforts must be made to ensure this case is not lost, not just for my sake but for the freedom of all Canadians,” Barber said.

In June 2006, Barber, a mayoral candidate that year, was appearing at Mississauga council’s public question period, as he has frequently done over the years, and an argument erupted.

Barber was informed of a policy that had been put into effect without advance public notice that any question asked had to pertain to an item on that day’s agenda.  This was a departure from long-standing practice and it took Barber and Roy Willis, another veteran citizen watchdog, by surprise.

The speakers didn’t understand what had happened, and in their subsequent efforts to find out, heated words were exchanged with members of council. Both men were escorted from the chamber by security guards.  Barber left under protest, followed by two security guards.

The four-time mayoralty candidate maintains that only the mayor has the authority to eject a member of the public from the council chambers.

Somewhere between the council chamber and the parking garage, Barber is alleged to have pushed a female security guard and stepped on one of her feet.

He was arrested and charged with two counts of assault and one count of causing a disturbance and held in jail two days for a bail hearing.

Peel police arrested and charged Barber the same day, based on the complaint of the two security guards.

The officers acted professionally and had reasonable grounds to lay the charges, according to the police statement of defence.

Barber’s allegations are “bald assertions and lacking in material fact,” according to the City’s statement of defence.

The City will defend itself vigorously in court if it has to do so, City solicitor Mary Ellen Bench said.

Asked if he plans to pursue the case, Barber told The News, "I'm going to try to do as much as I can, with the little that I have."

Me again. Just asking for clarification of something else you wrote. This part, "I'm all for democracy Barber...you don't comprehend democracy. You don't understand what when the voters reject you (as they have rejected you many many times), you're done." I agree with that "you're done" part. Question. What IS Democracy to you? And yes, serious question.

I'm A realist, Not A "Demoralizer"

You wacky Barberites (Barber himself included) need to clue into the reality that virtually nobody in this city supports you. Virutally nobody agrees with anything you say or do and virtually nobody votes for you. With that in mind, a rational person would know that they don't have the right to represent anyone at council, you don't have the right to show up and hold a virtual seat on council through the visitor's gallery. Until you get a majority of voters to support you, you don't have a voice in the affairs of the city beyond what anyone else has.

I'm All For Democracy Barber

I'm all for democracy Barber...you don't comprehend democracy. You don't understand what when the voters reject you (as they have rejected you many many times), you're done. After being rejected by the electorate, you don't represent anyone, you don't sit on council and you don't get to call the shots. You certainly don't get to assault security guards or get a free pass on trespassing in the council chambers when you were clearly and unambiguously told to leave. Skuns and Salamanders are about the only residents of Mississauga who don't comprehend that you are an utter fool who will NEVER be mayor.

Mantis in Sheep’s Clothing…

The city of Mississauga is not an autocratic police (pseudo) state. The people in power must respect the citizens and citizen-activists/critics. Otherwise, the city of Mississauga Council (the lowest level of government in Canada) must have an “official opposition” (which is indispensable in democratic system) to keep check and balance on the politicians exercising power. If you eliminate participatory democracy at the municipality level, you are abandoning your city to the ‘crime syndicate’. People like Don, Muse, Willis and others who bother and dare to care the city’s affairs are truly INDISPENSABLE.

You toss all of these Absolutes out here about what happened on June 7, 2006. Show us the data to support your proclamations that the City acted properly. Show us the DOCUMENTATION to back up what YOU wrote about the City of Mississauga's Corporate Security guards and the City's Security operation. That's all I ask. Back up your "the City acted properly". I need to know what "properly" means to you. Thanks.

Police Did Their Job

The police did their job and the did it properly. So did the city. You were clearly in the wrong. You were told to leave and you refused so they removed you.
